1. Who we are
Perpetual Desk(“the Service”, “we”, “us”) is a futures-trading education platform — a resource library, strategy finder, and trade journal — operated by Envyss Analytics Ltd. Questions about these terms: envyssanalyticsltd@gmail.com.
2. Accepting these terms
By creating an account or using the Service you agree to these Terms of Use, our Privacy Policy, and our Risk Disclosure. If you don’t agree, don’t use the Service.
You must be at least 18 years old and legally able to enter into this agreement. The Service is not directed at anyone under 18.
3. Your account
- Give us accurate information and keep it current. One account per person; accounts are personal and non-transferable.
- You are responsible for your password and for everything done under your account. Use a strong, unique password and tell us immediately at envyssanalyticsltd@gmail.com if you suspect unauthorized access.
- Each account is assigned a sequential member number at sign-up (member #1 was the first account, and so on). It is a cosmetic identifier only — it carries no rights, priority, or monetary value.
4. Plans, pricing, and billing
Parts of the Service are free; others may require a paid plan. Prices and plan features are shown on the pricing page and may change — changes apply from your next billing cycle, never retroactively. Where paid subscriptions are offered: they renew automatically until cancelled, you can cancel any time with effect from the end of the current billing period, and any statutory cancellation or refund rights you have (for example as an EU or UK consumer) remain unaffected.
5. Education only — not financial advice
Everything on the Service — lessons, library resources, strategy content, journal analytics, and any AI-generated commentary — is general education. It is not investment advice, trading advice, a recommendation, or a solicitation to buy or sell futures, securities, or any other financial instrument, and it is not tailored to your circumstances.
- We are not a broker, dealer, investment adviser, or commodity trading advisor, and we do not execute trades or handle funds.
- Any trading decisions you make are yours alone. Before trading, consider your financial situation and consult a licensed professional where appropriate.
- The Risk Disclosure is part of these terms. Read it.
6. No performance claims
We make no promises about trading results. Examples, statistics, strategy write-ups, and journal analytics describe concepts or historical observations, not expected outcomes. Past performance — real or hypothetical — does not indicate future results.
7. Our content and your license
The Service and its content (text, lessons, design, code, data, trademarks) belong to Envyss Analytics Ltd or its licensors. While your account is in good standing we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own learning.
- Don’t copy, scrape, redistribute, resell, publicly post, or build derivative products from the library or lesson content.
- Don’t share account access to circumvent plans.
8. Your content and your data
You own your journal.Trades, day notes, and trading models you save are stored against your account so they follow you across devices; we claim no rights over them beyond what’s needed to store and return them to you, and you can export them (markdown) or have them deleted with your account at any time. Lighter preference data (saved resources, lesson progress, quiz answers, AI settings) stays in your browser — see the Privacy Policy. If you submit content to AI features, you confirm you have the right to do so.
9. Acceptable use
- No unlawful use, and no use that harms the Service or others.
- No probing, scraping, reverse engineering, rate-limit evasion, automated account creation, or attempts to access other users’ data or non-public areas of the Service.
- No abusive, excessive, or resale use of included AI features; fair-use limits apply.
10. Third-party services
The Service runs on third-party infrastructure and can call third-party AI providers to power optional features. Their services are governed by their own terms. We are not responsible for third-party services we don’t control.
11. Availability and changes
The Service is provided “as is”and “as available”. We may add, change, or remove features, and we may suspend or discontinue the Service. We’ll aim to give reasonable notice of material changes where practical.
12. Disclaimers and limitation of liability
To the fullest extent permitted by law: we disclaim all warranties, express or implied; we are not liable for trading losses, lost profits, lost data, or indirect, incidental, special, or consequential damages arising from your use of the Service; and our total liability for all claims is limited to the greater of the amount you paid us in the 12 months before the claim or £50.
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law (including for fraud, or for death or personal injury caused by negligence), or your statutory rights as a consumer.
13. Indemnity
You will indemnify Envyss Analytics Ltd against claims and costs (including reasonable legal fees) arising from your breach of these terms or misuse of the Service, except to the extent caused by us.
14. Termination
You can stop using the Service or ask us to delete your account at any time via envyssanalyticsltd@gmail.com. We may suspend or terminate accounts that breach these terms or create risk for the Service or other users. Sections 5–13 and 15–16 survive termination.
15. Changes to these terms
We may update these terms as the Service evolves. For material changes we’ll give notice on the site (or by email) before they take effect; the “Last updated” date above always reflects the current version. Continuing to use the Service after changes take effect means you accept them.
16. Governing law
These terms are governed by the laws of England and Wales, and disputes belong to the courts there — except that if you are a consumer you keep any protection and venue rights granted by the mandatory laws of the country you live in.
